Terms and Conditions

Last updated: [[MONTH_YEAR]] Version: [[LEGAL_VERSION]]

1. Scope

These Terms apply to contracts for artworks concluded through i-innocent.art between [[LEGAL_FULL_NAME]], trading under the artist name I. Innocent, [[FULL_ADDRESS]] (the “Seller”) and the customer.

A consumer is a natural person acting mainly outside their trade, business or profession. A business customer acts in the course of commercial or independent professional activity.

2. Contract language and storage

Available contract languages: [[CONTRACT_LANGUAGES]]. The contract text is stored and made available as follows: [[CONTRACT_TEXT_STORAGE_AND_CUSTOMER_ACCESS]]. Order data, these Terms and the withdrawal notice are supplied on a durable medium.

3. Artwork information

The relevant artwork page states the material characteristics, including title, artist, year, medium, support, dimensions, framing, signature, originality or edition, artwork ID, certificate, condition and availability where applicable.

Screen display and photography may create minor differences caused by device settings, lighting or reproduction. This does not permit deviation from expressly agreed characteristics or misleading alteration.

4. Order and contract formation

Website presentation is an invitation to order unless expressly stated otherwise. The customer can review and correct information before submitting the order. Activating the clearly labelled payment-obligation button submits a binding offer.

An automated receipt acknowledgement is not acceptance unless expressly identified as such.

[[INSERT_THE_REVIEWED_ENGLISH_VERSION_OF_THE_SELECTED_CONTRACT_ACCEPTANCE_EVENT]].

If an order cannot be accepted, any amount already collected will be reimbursed promptly.

5. Unique-work availability

Originals are generally unique works. Reasonable controls are used to prevent double sales. If a work is no longer available before contract formation, the order will not be accepted and any payment will be refunded.

6. Prices and tax

Prices are in euros. [[INSERT_THE_REVIEWED_ENGLISH_VERSION_OF_THE_SELECTED_VAT_MODEL]]. Shipping and individually agreed crating, logistics, customs or installation charges are shown before binding order or expressly agreed.

7. Payment

Available methods are displayed at the start of checkout: [[ACCEPTED_PAYMENT_METHODS]]. External payment providers may process payment.

8. Delivery

Delivery is made to the supplied address within offered regions. Restrictions, charges, preparation time and delivery information appear on the artwork page, checkout and Shipping & Returns page. Specialist art logistics may require an individual quotation.

9. Retention of title

The artwork remains the Seller’s property until the purchase price is paid in full.

10. Withdrawal

Consumers have a statutory right of withdrawal where the legal conditions are met. See the separate notice, model form and Withdraw from contract function.

11. Commissions

The statutory withdrawal exception may apply where production is governed by the customer’s individual selection or specification or is clearly personalised. This will be disclosed before concluding a commission contract. It does not apply merely because a completed work is an original or unique work.

12. Defect rights

Statutory defect rights apply. Express information about material, technique, dimensions, framing, signature, certificate and condition forms part of the agreed characteristics where incorporated into the contract.

13. Authenticity

Where described as an original or unique work, the Seller confirms that the physical work is an original by the stated artist. Where stated, it is accompanied by a Certificate of Authenticity carrying the artwork ID and identifying information.

14. Copyright

Purchase transfers ownership of the physical artwork. Copyright and rights of reproduction, distribution, digitisation, commercial publication, adaptation, merchandising or NFT exploitation do not transfer unless expressly agreed in writing. Statutory rights attached to owning the physical original remain unaffected.

15. No value guarantee

No statement guarantees future market, resale or investment value. Artworks are not offered as financial investments.

16. Liability

Statutory liability rules apply.

17. Consumer dispute resolution

[[DISPUTE_RESOLUTION_TEXT_ENGLISH]]

18. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protections of the consumer’s country of habitual residence. No exclusive jurisdiction clause is imposed on consumers.
